We suggest that you carefully read the Terms and Conditions that are detailed below as this forms the basis of the sale agreement between you and Baby Shop Direct when you purchase goods from our website. If you proceed with your purchase you are acknowledging that you have read these Terms and Conditions. Baby Shop Direct updates this website regularly; however we make no representation as to the accuracy or completeness of any information or services of the website. All information and services are provided on the basis that you undertake the responsibility for assessing at your own risk. We may from time to time, change or add content to this website (including our Terms and Conditions) without notice. We are not liable to you or anyone else if errors occur in the information on Baby Shop Direct or if that information is not up-to-date. At all times we will try to ensure that the images on our website are as accurate and as close to the actual product as possible. It is essential that you use the actual written description of each product when deciding to purchase a product from Baby Shop Direct. To the extent that Baby Shop Direct may be liable for a breach of a condition of The Trade Practices Act 1974 (other than a condition or warranty implied by section 59 of the Act), the maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.
All prices are listed in Australian Dollars and include GST and are subject to change without notice. The prices indicated exclude freight and handling. Baby Shop Direct will at all time use our best efforts to ensure that the prices on our website are accurate at any point in time. The prices that are displayed on the website are only current at that particular point in time and we reserve the right to change our prices at any time without prior notice. When price changes occur, they will be automatically updated on the website. If a price changes on the Baby Shop Direct website before you place your order, Baby Shop Direct at its discretion, reserves the right not to honour this price. Price Promise If you find a cheaper price on another Online Australian retailer within 24 hours of placing your order on Baby Shop Direct, we will refund the difference back into the nominated account provided at checkout once your order is processed. The item must be in stock, and be the exact item to which we stock (ie. pack size, colour and supplier stockcode). The Price Promise does not include liquidation, clearance, auction (ie. eBay™), search engine retailers nor freight charges. Baby Shop Direct must be contacted via websales@babyshopdirect.com.au within 24 hours advising the Retailer Name and weblink to the cheaper product. If your order has not been placed yet, add these details to the Comments box upon checkout. We reserve the right at any time to not honour a price match. We want you to be completely satisfied with everything you purchase from Baby Shop Direct. Change Of Mind Baby Shop Direct reserves the right to assess the condition of returned goods prior to offering a repair, exchange or refund. This may result in the product being sent away for assessment and a repair, exchange or refund being refused. Under no circumstances will a refund or credit be given if the products received are used, worn, washed, soiled, damaged or without the original packaging. These items will be returned to the customer with the customer liable for any return shipping costs. Once the item has been received back to our warehouse, and is deemded to be in resaleable condition, a staff member will email you an On-line Credit Voucher which must be used within 3 months of being issued, after which will expire. To redeem the Credit Voucher you must enter the code at Checkout. Credit Vouchers must be used in whole and cannot be split. Change will cannot be given if the purchase price is lower than the Credit Note amount. Products offered on sale are not returnable and postage & handling charges of returned products are not refundable unless faulty. This type of sale is considered final. Special Orders Baby Shop Direct takes pride in supplying quality products. If goods are found to be faulty, as a result of manufacturing defect, you must contact us within 7 days of delivery in writing by email to websales@babyshopdirect.com.au. We will then work out the best way to rectify this Refunds All refunds are made the same way as the original payment method was made. Postage and handling charges of returned products are not refundable unless a product is deemed faulty. Free Delivery for a Gift Voucher is between 1-4 working days through standard Australia Post only. A freight charge will be applied on the products purchased when redeeming the Gift Voucher. If you wish to have your Gift Voucher delivered via courier or Registered Mail, a delivery charge will apply. Please email websales@babyshopdirect.com.au for queries. Gift Vouchers purchased on-line at www.babyshopdirect.com.au can only be redeemed on-line at www.babyshopdirect.com.au and are valid for 6 months from the date of purchase, after which will expire. Promotional discounts / Codes cannot be used when purchasing a Gift Voucher. Gift Vouchers must be used in one transaction only and cannot be split. Change will not be given should the purchase amount be less than the value of the Gift Voucher. Please treat Gift Vouchers as cash as we cannot replace lost or stolen Gift Vouchers. Shipping costs are influenced by the size and weight of the product and location. Exact shipping and handling costs are calculated in the shopping cart and will be added to the order total before checkout. We are an outgoing warehouse therefore we cannot accept pickups under any circumstances. All orders from our website will be delivered by independent couriers. We use Australia Post, Toll Ipec and Fastway. They cannot guarantee a date or time due to the high volume of deliveries, nor can couriers call prior delivery. Once items are shipped, the items are out of our control. When your order is dispatched, you will be supplied a tracking number via email advising that the item has been shipped and the tracking number. Using the tracking number, you can Track & Trace your item online. Unfortunately we do not accept other modes of transit and cannot have items shipped through any other accounts other than our own. We cannot deliver bulky or heavy items (over 15kg) to PO Boxes. Delivery of items can be left if unattended, as long as this selection is made in Checkout. In some instances, couriers my deem that it is too unsafe to leave items, in which they will leave a calling card. If you do not wish for your items to be left and you are not home, a calling card will be left to arrange another delivery time or to advise pickup at your local centre. Please ensure all shipping details are correct as a re-shipping fee will be charged if the item is undelivered and returned to us. Items that are left will only be placed in an easy to access area (generally the front door), please ensure it is an area which is safe from damage, whether and theft as Baby Shop Direct and other affliates will not be responsible for damage or loss of goods. Please ensure you open your parcel and check all items are included and are undamaged. If goods are damaged in transit, you must contact us within 48 hours of receiving your goods by email. Claims for missing or damaged items cannot be accepted after 48 hours of receiving your goods. Items purchased from Baby Shop Direct are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon pick up by the courier. Baby Shop Direct takes great care when packaging your order and rarely have our packages been damaged in transit. Availability of Products All products on our website are supplied subject to availability. Despite our best intentions, sometimes the website will enable you to order a product that is out of stock. When this occurs, we will notify you within 72 hours and inform you of an approximate timeframe. We will happily organise a refund if a product cannot be supplied within a reasonable time. We cannot place orders for discontinued or clearance items. All furniture items are on order only basis and may take up to 12 weeks to supply. Furniture will incur a 50% cancellation fee if cancelled outside of 72 hours from the time of purchase. Incorrect Goods Supplied If Baby Shop Direct supplies you with an incorrect product, we will supply you with the correct product once the incorrect product has been returned to us. In the event of a wrong product being supplied, you must contact us within 24 hours of receiving your goods. The freight cost incurred will be reimbursed by Baby Shop Direct. Use of Goods It is essential that all products purchased from Baby Shop Direct are only used in the manner that they are intended to be used. Products purchased from us may not be modified in any way whatsoever from the condition they were supplied in. We accept no responsibility if products are modified in any manner from the condition they were supplied and will void the manufacture warranty, Order Cancellations All order cancellations must be emailed or sent in writing. Orders cannot be cancelled after they have been shipped. Fees apply to cancel orders. General orders will incur a 20% cancellation fee. Furniture orders incur a 50% cancellation fee and custom orders or special make orders incur a 100% cancellation fee.
We accept payment via Visa and MasterCard only. All credit card transactions are secured using 1024 Bit Secure Socket Layer (SSL) Encryption. No credit card information is stored by this site. All credit card information is processed by Westpac and therefore complies with their strict privacy and security policies.
